ONE CARE 50/50 Draw Rules (the “Rules”)
ONE CARE will be conducting a month long 50/50 draw.
By purchasing a 50/50 ticket issued by ONE CARE, the ticket purchaser acknowledges that they have read, understood and agreed to these to these Rules. ONE CARE reserves the right to amend and revise these Rules from time to time.
In the event of a conflict between any information issued by Rafflebox and contained on the ticket, such conflict shall be resolved in accordance with the following priority;
(i) the Alcohol and Gaming Commission of Ontario (“AGCO”) Regulations;
(ii) these Rules; and
(iii) the ticket.
1. Eligibility
Ticket purchasers must be 18 years of age or older. Tickets must be purchased in Ontario and Ticket purchasers must be physically located in the province of Ontario at the time of purchase.
Directors, shareholders, officers, executive members and employees of ONE CARE are not eligible to purchase tickets.
2. Tickets
Online e-tickets for the 50/50 draw will be sold using an electronic draw system supplied by Rafflebox. There are no refunds on ticket purchases.
Tickets will be priced as follows:
• 5 tickets for $10.00
• 30 tickets for $20.00
• 150 tickets for $50.00
• 300 tickets for $75.00
ONE CARE will collect and track all monies in a separate account for 50/50 revenue.
The ticket purchaser is solely responsible for ensuring they receive the correct number of tickets and for handling the tickets once issued. ONE CARE is not responsible for lost or destroyed tickets.
3. Validity of Tickets
Only tickets that have been verified by ONE CARE will be considered valid. ONE CARE will consider a ticket valid if the ticket is:
a) sold and issued by ONE CARE for the purpose of the 50/50 draw;
b) contains the proper name and telephone number on the ticket provided by Rafflebox; and,
c) paid for in full by the ticket purchaser within the specified deadline.
ONE CARE reserves the right to satisfy itself as to the validity of any ticket that is presented as a winning ticket. ONE CARE may not award a prize for tickets that are not valid or to ticket holders who are in breach of these Rules. ONE CARE may refuse to send or forward prize to an address outside of Ontario or to an address in any jurisdiction which sending or forwarding is prohibited by law.
4. 50/50 Draw Date
All draw dates are outlined in Appendix A: Draw Schedule.
5. Draws
The winning 50/50 ticket will be drawn randomly by a bona fide member of the organization using the Rafflebox system at the ONE CARE Stratford Office. The name and ticket number of the winning ticket holder for each draw will be posted on the ONE CARE website and social media. The winner will be contacted by phone and given instructions on how to claim their prize.
6. Consent to Use of Personal Information
By purchasing a ticket, the ticket holder consents to the use of their image, first and last name and ticket number being posted on ONE CARE’s website and social media.
7. Prize
The prize value of the winning ticket will be 50% of the funds raised through tickets sales, payable by cheque.
8. Prize Claim
Any 50/50 proceeds unclaimed will be secured and placed in safekeeping for a period of six (6) months from the date of the draw. If, at the end of six (6) months the proceeds have still not been claimed, the total amount of the prize held in trust will be included in the gross proceeds of the lottery event.
9. Representation, Warranties and Limited Liability
Other than as identified in these Rules, ONE CARE makes no representations or warranties of any kind whatsoever about the draw, the tickets, or the electronic draw system used to conduct the draw. ONE CARE shall not be liable for any loss, harm or damage suffered by any person as a result of the operation of the draw or the electronic draw system used to conduct the draw or the failure of the electronic raffle system to operate properly or at all. The liability of the ONE CARE shall be limited to the purchase price of the ticket, which is not tax deductible.
10. General Provisions
These Rules shall be governed by, subject to and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada as applicable therein. The Courts of the Province of Ontario shall have exclusive jurisdiction in association with any action or other legal proceeding based on or arising out of these Rules or any raffle conducted by ONE CARE.
The headings in these Rules are for convenience of reference only and do not affect the interpretation of these Rules.
