NO PURCHASE IS NECESSARY TO ENTER THIS SWEEPSTAKES. ODDS OF WINNING DEPEND UPON THE TOTAL NUMBER OF ELIGIBLE ENTRIES. A DONATION OR DIRECT PAYMENT TO THE SPONSOR WILL NOT INCREASE YOUR CHANCES OF WINNING.

These rules (the “Official Rules”) contain an arbitration agreement and class action waiver which affect your legal rights. Please review them carefully before entering the Sweepstakes.

The WestJet Hope Takes Flight Sweepstakes (the “Sweepstakes”) begins on Friday, July 17, 2026 at 12:00pm ET (the “Sweepstakes Start Date”) and ends on Friday, September 25, 2026 at 11:00am ET (the “Sweepstakes End Date”) (collectively, the “Sweepstakes Entry Period”). All times are measured by Eastern Time (ET) in Canada.

SPONSOR
The Sweepstakes is sponsored by and for the benefit of the Foundation for Prader-Willi Research Canada (the “Sponsor”), a federally incorporated non-profit organization with charitable registration number 855717385RR0001.

ELIGIBILITY
The Sweepstakes is only open to:
(a) legal residents of Canada and
(b) individuals eighteen (18) years of age or older at the time of entry.
Entries are limited to individuals only; commercial enterprises and business entities are not eligible. By participating in the Sweepstakes, each participant unconditionally accepts and agrees to comply with and abide by the terms and conditions stated in these Official Rules which shall be final and binding in all respects, agrees to be bound by the decisions of Sponsor, and warrants that she/he is eligible to participate in the Sweepstakes.
The Sweepstakes is void where prohibited or restricted by law and is subject to applicable federal, provincial, and municipal laws and regulations.

HOW TO ENTER

1.    To Enter by Donating:
No purchase necessary Participants may enter the Sweepstakes during the Sweepstakes Entry Period; participants may enter by visiting https://www.rafflebox.ca/raffle/fpwr (the “Sweepstakes Website”) during the Sweepstakes Entry Period and following the on-screen prompts. If you donate: 
$10 = 10 Entries = Supporter of Hope
$25 = 50 Entries = Family Champion
$50 = 120 Entries = Research Advocate
$100 = 300 Entries = Future Builder
Participants will receive an email confirmation at the email address provided on the Sweepstakes Website. All donations are final, non-refundable, and not eligible for a charitable tax receipt. There is a limit of 50,000 entries per person. 

2.    To Enter Without Donating:
Participation in the Sweepstakes is voluntary and does not require you to make a donation or payment to the Sponsor. If you wish to enter the Sweepstakes without donating, you may enter for free (“No Donation Necessary”) as follows: 

To enter the Sweepstakes without making a donation you must complete 2 steps: 

Step 1: To enter the Sweepstakes without making a donation, hand-print your full name, complete mailing address (including postal code), daytime telephone number (including area code), and a unique and original handwritten essay of at least fifty (50) words explaining  “Why is community support important for families living with Prader-Willi syndrome?” on a plain piece of paper. Place your entry in a sealed envelope and mail/courier it with sufficient postage to:

Mail/Courier-in entries must be received no later than 11:59:00 pm ET on Monday, September 21, 2026.  In order to be eligible. Limit one (1) no purchase entry per outer envelope. Incomplete or late submissions will not be accepted.

Step 2: Upon receipt of a valid mail/courier entry, you will receive one (1) entry into the Sweepstakes.
•    Limit: one (1) No Purchase Necessary entry per person during the Sweepstakes Entry Period.
•    Entries using the No Donation Necessary method that do not clearly provide all the above-listed 
•    information will be deemed ineligible (as determined in Sponsor’s sole discretion).
•    Duplicate, copied, or substantially similar essays will be deemed invalid.

All essays submitted in connection with this Sweepstakes by entrants shall be the exclusive property of the Foundation for Prader-Willi Research Canada (“FPWR Canada”) and its Affiliates. To the extent that the entrant has or obtains any right, title, or interest in or to any essay submitted, the entrant hereby assigns and agrees to assign to FPWR Canada or any FPWR Canada Affiliate as FPWR Canada shall specify, all of such right, title, and interest therein and thereto. The entrant agrees to execute any additional documents, applications, or registration forms as may be presented to him/her to establish FPWR Canada and its Affiliates’ rights as stated herein. The entrant also waives, in favour of FPWR Canada or such FPWR Canada Affiliate(s) designated by FPWR Canada, any moral rights in any essay submitted in connection with this Sweepstakes.

PRIZE
Grand Prize: One roundtrip flight for two guests to any regularly scheduled and marketed WestJet destination*!
(*No cash value, fees, taxes, surcharges not included, blackout dates and restrictions apply.)

Prize Conditions:
•    This voucher is valid for one (1) roundtrip flight for two (2) guests to any regularly scheduled and marketed WestJet destination. Gift of flight vouchers are not valid for redemption on WestJet Vacations' or Sunwing Vacations' packages, flights operated by Sunwing Airlines, charters, codeshare, or interline flights.

•    This voucher is limited and subject to promotional space availability of eligible fare options and flight schedule. Not all flights have promotional space.

•    Fees, taxes, and surcharges are the responsibility of guests traveling and must be paid for at the time of booking with a valid credit card. Vouchers do not include optional fees such as checked baggage or cabin upgrades.

•    This voucher cannot be used on some dates, including statutory holidays and peak travel dates

•    Flights must be roundtrip to and from the same locations. Flights must depart from city A to city B and return from city B to city A. All guests must travel together on the same itinerary, dates, and flights.

•    All bookings and travel must be completed by July 17, 2027.

•    Gift of flight vouchers cannot be extended. Additionally, changes to travel dates or guest names are not permitted once a booking has been confirmed. 

•    Bookings made with a gift of flight voucher are not eligible for paid cabin upgrades except where the option to pay for an upgrade is available when checking in for the flight 24 hours prior to departure.

•    This voucher will become null and void if travel is cancelled once a booking is confirmed.

•    The individual booking the flights must be over the age of majority in their province.

•    This voucher must be taken as offered and is not redeemable for cash.

•    Gift of flight vouchers cannot be sold. In the event that it has been sold, the voucher will become void, and any flight bookings made with it will be cancelled immediately without notice or reimbursement. WestJet does not handle the payment, guarantee transactions, or buyer protection or seller certification, nor will WestJet be liable for the loss of funds resulting from a fraudulent transaction.

•    Guests travelling on a WestJet gift of flight voucher are not entitled to compensation amounts provided under passenger rights regimes. By redeeming the gift of flight voucher, all guests travelling agree to release, and waive all claims against, WestJet relating to any and all liability, damage, or compensation entitlement arising under Canada's Air Passenger Protection Regulations.

•    WestJet is not responsible for lost or mishandled vouchers. Once a voucher has been delivered to you, you are directly responsible for it.

WINNER SELECTION & ODDS
•    On or about Friday, September 25, 2026, (the "Drawing Date"), Sponsor will select the potential Sweepstakes winner ("Potential Winner") in accordance with these Official Rules. 
•    The Potential Winner will be selected by random drawing using a random number generator algorithm from all eligible entries received by the Sponsor during the Sweepstakes Entry Period. 
•    Odds of winning depend on the total number of eligible entries received.
•    The Potential Winner will be notified by email and/or by telephone shortly after the Drawing Date, using the email address or telephone number provided with the selected entry, and will be conditionally awarded the Sweepstakes Grand Prize subject to verification of eligibility and compliance with the terms and conditions of these Official Rules.

 •    If a Potential Winner does not respond within one forty-eight (48) hours of the first notification attempt, or if the prize notification is returned as undeliverable, or if the Potential Winner fails to provide the necessary information to confirm the Potential Winner’s identity and eligibility to receive the Sweepstakes Grand Prize, such Potential Winner may be disqualified, and the Sponsor may, in its sole discretion, select an alternate Potential Winner to be selected by a random drawing from among the remaining eligible entries. The notification will include instructions for how to contact the Sponsor to provide name, address and other information that may be required to complete validation of eligibility and delivery of the Sweepstakes Grand Prize. 

•    No liability is assumed for any winner notification that is lost, intercepted or not received by a Potential Winner for any reason. 

•    In the event that a Potential Winner is disqualified for any reason, the Sponsor may, in its sole discretion, award the Sweepstakes Grand Prize to an alternate Potential Winner who will be selected by a random drawing from among the remaining eligible entries. 

PUBLICITY RELEASE: 
Except where prohibited or restricted by law, Winner's acceptance of, and Guest’s participation in, the Prize, or any portion thereof, constitutes the Winner’s and Guest’s agreement, permission and consent for Sponsor and any of their designees to use and/or publish the Winner's and/or guest’s full name, city and province or territory of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, and/or statements made by the Winner and/or guest regarding the Sweepstakes or otherwise, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, publicity, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval. Winner is solely responsible for acquiring guest's agreement and consent for all required documents, and failure to do so will disqualify Guest from participating in any portion of the Prize. 
PRIVACY: 
To participate in the Sweepstakes, entrants will be required to supply certain information about themselves on the Sweepstakes Website entry pages. Sponsor has specified on the Sweepstakes Website which information is mandatory in order to participate in the Sweepstakes. This information will be used by Sponsor for the purposes of administering the Sweepstakes, and may be shared with their respective affiliates, subsidiaries, advertising, promotion and fulfillment agencies, legal advisors, and service providers. 

GENERAL CONDITIONS: 
The Released Parties shall not have any obligation or responsibility, including any responsibility to award any prize to entrants, with regard to: (a) entries that contain inaccurate information and/or do not comply with and/or violate these Official Rules; (b) entries, prize claims and/or notifications that are lost, late, incomplete, illegible, unintelligible, damaged and/or otherwise not received by the intended recipient, in whole or in part, due to computer, human and/or technical error of any kind; (c) entrants who have committed fraud and/or deception in entering and/or participating in the Sweepstakes and/or claiming any prize; (d) telephone, electronic, hardware, software, network, Internet and/or computer malfunctions, failures and/or difficulties; (e) any inability of a winner to accept a prize for any reason; (f) if a prize cannot be awarded due to delays and/or interruptions due to Acts of God, natural disasters, terrorism, weather and/or any other similar event beyond Sponsor’s reasonable control; or (g) any damages, injuries and/or losses of any kind caused by and/or resulting from awarding, acceptance, possession, use, misuse, loss and/or misdirection of any prize and/or resulting from participating in this Sweepstakes and/or any promotion and/or prize related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (x) tampering with the entry process and/or the operation of the Sweepstakes, the Sweepstakes Website, and/or with any website promoting the Sweepstakes; (y) acting in violation of these Official Rules; or (z) entering and/or attempting to enter the Sweepstakes multiple times in violation of these Official Rules and/or the use of any robotic and/or automated devices to submit entries. If Sponsor determines, in its sole discretion, that technical difficulties, malfunction, error, disruption and/or damage and/or other unforeseen events compromise the administration, security, fairness, integrity, proper conduct or viability of the Sweepstakes, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Sweepstakes, including the entire Sweepstakes, and/or modify the Sweepstakes and/or award the prizes from all eligible entries received as of the termination date. Sponsor reserves the right to suspend, modify and/or cancel the Sweepstakes before the scheduled Sweepstakes End Date. In the event the Sweepstakes is cancelled, all entries into such Sweepstakes will be deemed null and void, all payments will be refunded, no winners will be selected and no prizes will be delivered. 

GOVERNING LAW; SEVERABILITY; WAIVER: 
The Sweepstakes and these Official Rules shall be subject to and governed by the laws of the Province of Ontario and Canada. If a court of competent jurisdiction finds any provision of these Official Rules, or their application to a particular person or circumstances, is invalid or unenforceable to any extent, then the remainder of these Official Rules, and the application of all of these Official Rules to other persons or circumstances, shall not be affected by that determination, and shall remain enforceable to the fullest extent permitted by law. The failure of Sponsor to enforce at any time any provision of the Official Rules shall not be considered a waiver of such provision or any other provision and shall not deprive Sponsor of 
the right thereafter to enforce such provision or any other provision. 

MANDATORY ARBITRATION AGREEMENT; CLASS ACTION WAIVER: 
Any claim, other than a claim by Sponsor, that is not resolved informally must be resolved in accordance with the below arbitration provisions. Unless prohibited by federal law, each entrant, including, without limitation, any Potential Winner or Sweepstakes Winner, agrees to arbitrate any and all claims and disputes relating in any way to such entry or the selection of a Potential Winner or Sweepstakes Winner, or delivery or awarding of the Sweepstakes Grand Prize or any other prize (“Arbitration Claims”), except for Arbitration Claims concerning the validity, scope or enforceability of this arbitration provision, through BINDING INDIVIDUAL ARBITRATION. This Arbitration Agreement shall be governed by the Ontario Arbitration Act, 1991. 

In any Arbitration Claim to be resolved by arbitration, neither the entrant nor Sponsor will be able to have a court or jury trial or participate in a class action or class arbitration. Other rights that entrant and Sponsor would have in court will not be available or will be more limited in arbitration, including the right to appeal. Entrants waive the right to a court or jury trial. All disputes shall be arbitrated on an individual basis, and not as a class action, representative action, class arbitration or any similar proceeding. The arbitrator(s) may not consolidate the claims of multiple parties. The arbitrator’s authority is limited to entrant and Sponsor alone, unless otherwise specifically stated herein. No arbitration decision will have any preclusive effect as to non-parties. The arbitrator’s decision shall be final and binding. The parties agree that this arbitration provision extends to any other parties involved in any Arbitration Claims, including, but not limited to, the Released Parties. This arbitration provision shall take precedence over the rules of the arbitration organization or arbitrator in the event of any conflict. 
The cost of the arbitration shall be shared equally by Sponsor and entrant, but Sponsor and entrant shall bear their own costs and attorney’s fees associated with their participation in the arbitration. Notwithstanding any other provision herein, if the foregoing class action waiver and prohibition against class arbitration is determined to be invalid or unenforceable, then this entire arbitration provision shall be void. If any portion of this arbitration provision other than the class action waiver and prohibition against class arbitration is deemed invalid or unenforceable, it shall not invalidate the remaining portions of this arbitration provision. 

Prior to initiating an arbitration proceeding under this provision, entrant shall give Sponsor written notice of the Arbitration Claim (a “Claim Notice”) and a reasonable opportunity, not less than thirty (30) days, to resolve the Arbitration Claim. Any Claim Notice to Sponsor shall be sent by mail to the Foundation for Prader-Willi Research Canada, 19-13085 Yonge Street, Suite #370, Richmond Hill, Ontario L4E 0K2. Any Claim Notice must (a) identify the entrant by name, address, email address, and telephone number; (b) explain the nature of the Arbitration Claim and the relief demanded; and (c) be submitted only on behalf of entrant, and not on behalf of any other party. Entrant must reasonably cooperate in providing any information about the Arbitration Claim that Sponsor reasonably requests and must give Sponsor a reasonable opportunity to respond to the demand for relief. The provisions of this section shall not apply to claims by Sponsor.

NOTICE: 
Sponsor reserves the right to prosecute and seek damages against any individual who attempts to deliberately undermine the proper operation of the Sweepstakes in violation of these Official Rules and/or criminal and/or civil law. ADMISSIBILITÉ
Le Concours est uniquement ouvert :
(a) aux résidents légaux du Canada, et
(b) aux personnes âgées de dix-huit (18) ans ou plus au moment de l’inscription.
Les inscriptions sont limitées aux particuliers uniquement; les entreprises commerciales et les entités commerciales ne sont pas admissibles. En participant au Concours, chaque participant accepte inconditionnellement et s’engage à respecter et à se conformer aux modalités énoncées dans le présent Règlement officiel, lequel est définitif et contraignant à tous égards. Il accepte également d’être lié par les décisions du Commanditaire et garantit qu’il est admissible à participer au Concours.
Le Concours est nul là où la loi l’interdit ou le restreint, et il est assujetti aux lois et règlements fédéraux, provinciaux et municipaux applicables.

2. Participation sans faire de don :
La participation au tirage au sort est volontaire et n’exige pas de faire un don ou un paiement au commanditaire. Si vous souhaitez participer au tirage sans faire de don, vous pouvez le faire gratuitement (« Aucun don requis ») selon les modalités suivantes :
Pour participer au tirage au sort sans effectuer de don, vous devez compléter deux étapes :

Rédigez à la main, de façon lisible, sur une feuille de papier ordinaire :
• votre nom complet,
• votre adresse postale complète (y compris le code postal),
• votre numéro de téléphone de jour (avec indicatif régional),

Les participations envoyées par courrier ou service de messagerie doivent être reçues au plus tard à 23 h 59 (HE) le lundi 21 septembre 2026 pour être admissibles. À la réception d’une participation valide envoyée par courrier ou service de messagerie, vous recevrez une (1) participation au tirage au sort.

Les bons « cadeau de vol » ne sont pas valides pour les forfaits de Vacances WestJet ou Vacances Sunwing, ni pour les vols opérés par Sunwing Airlines, ni pour les vols affrétés, en partage de code, ou en interligne.

• Ce bon deviendra nul et non avenu si le voyage est annulé après la confirmation de la réservation.
• La personne effectuant la réservation doit avoir l’âge de la majorité dans sa province ou son territoire de résidence.
• Ce bon doit être accepté tel quel et ne peut être échangé contre de l’argent comptant.
• Les bons « cadeau de vol » ne peuvent pas être vendus. En cas de vente, le bon sera annulé, et toute réservation effectuée avec celui-ci sera immédiatement annulée sans préavis ni remboursement.
WestJet ne prend pas en charge les paiements, ne garantit pas les transactions, ni la protection des acheteurs ou la certification des vendeurs, et ne pourra être tenue responsable des pertes financières liées à une transaction frauduleuse.

SÉLECTION DU GAGNANT ET CHANCES DE GAGNER
• Le jeudi 30 octobre (la « Date du tirage »), ou autour de cette date, le Commanditaire sélectionnera le participant admissible au tirage (le « Gagnant potentiel ») conformément aux présentes Règles officielles.
• Le Gagnant potentiel sera sélectionné par tirage au sort aléatoire à l’aide d’un algorithme générateur de nombres aléatoires parmi toutes les participations admissibles reçues par le Commanditaire pendant la Période d’inscription au tirage.
• Les chances de gagner dépendent du nombre total de participations admissibles reçues.
• Le Gagnant potentiel sera informé par courriel et/ou par téléphone peu après la Date du tirage, à l’aide des coordonnées fournies dans la participation sélectionnée, et se verra attribuer le Grand Prix du tirage, sous réserve de la vérification de son admissibilité et du respect des conditions énoncées dans les présentes Règles officielles.
• Si un Gagnant potentiel ne répond pas dans un délai de quarante-huit (48) heures suivant la première tentative de notification, si l’avis de gain est retourné comme non distribuable, ou si le Gagnant potentiel n’est pas en mesure de fournir les informations requises pour confirmer son identité et son admissibilité à recevoir le Grand Prix, il pourra être disqualifié.
Le Commanditaire pourra alors, à sa seule discrétion, sélectionner un autre Gagnant potentiel par tirage au sort parmi les autres participations admissibles restantes.
• L’avis de gain comprendra des instructions sur la manière de communiquer avec le Commanditaire pour fournir le nom, l’adresse et toute autre information nécessaire à la validation de l’admissibilité et à la livraison du Grand Prix.
• Aucune responsabilité ne sera assumée en cas de notification de gain perdue, interceptée ou non reçue, quelle qu’en soit la raison.
• Si un Gagnant potentiel est disqualifié pour quelque raison que ce soit, le Commanditaire peut, à sa seule discrétion, attribuer le Grand Prix à un autre Gagnant potentiel, sélectionné par tirage au sort parmi les participations admissibles restantes.

AUTORISATION RELATIVE À LA PUBLICITÉ :
Sauf là où la loi l’interdit ou le restreint, l’acceptation du Prix par le Gagnant et la participation de l’Invité à une partie ou à l’ensemble du Prix valent consentement, permission et autorisation de la part du Gagnant et de l’Invité pour que le Commanditaire, ainsi que toute personne ou entité désignée par celui-ci, puisse utiliser et/ou publier, à l’échelle mondiale et à perpétuité, à des fins publicitaires, de promotion, de relations publiques, de marketing ou autres :
• le nom complet,
• la ville et la province ou le territoire de résidence,
• les photographies ou autres représentations,
• les images, portraits, vidéos,
• la voix,
• les témoignages ou
• toute déclaration faite par le Gagnant et/ou l’Invité concernant le tirage ou tout autre sujet,
et ce, dans tous les types de médias existants ou à venir, y compris, mais sans s’y limiter, la presse écrite, la télévision, la radio, les supports électroniques, le câble ou le Web (Internet), sans autre limitation, restriction, rémunération, avis, approbation ou révision préalable.
Le Gagnant est entièrement responsable d’obtenir le consentement et l’accord de l’Invité concernant tous les documents requis. Le défaut de le faire entraînera la disqualification de l’Invité quant à toute participation au Prix.

CONFIDENTIALITÉ :
Pour participer au tirage au sort, les participants devront fournir certaines informations personnelles via les pages de participation sur le site Web du tirage. Le Commanditaire précisera sur le site quelles informations sont obligatoires pour être admissible au tirage.
Ces informations seront utilisées par le Commanditaire uniquement dans le but d’administrer le tirage au sort et pourront être partagées avec ses filiales, sociétés affiliées, agences de publicité, de promotion ou de traitement des prix, conseillers juridiques, et fournisseurs de services.

CONDITIONS GÉNÉRALES :
Les Parties exonérées de responsabilité n’assument aucune obligation ni responsabilité, y compris celle d’attribuer un prix aux participants, en ce qui concerne :
a) les participations contenant des informations inexactes et/ou non conformes aux présentes Règles officielles, ou qui les enfreignent ;
b) les participations, réclamations de prix et/ou notifications perdues, en retard, incomplètes, illisibles, incompréhensibles, endommagées et/ou non reçues, en tout ou en partie, par le destinataire prévu en raison d’une erreur informatique, humaine et/ou technique, quelle qu’en soit la nature ;
c) les participants ayant commis une fraude et/ou une tromperie lors de leur inscription, de leur participation au tirage, et/ou lors de la réclamation d’un prix ;
d) les pannes, défaillances ou dysfonctionnements téléphoniques, électroniques, matériels, logiciels, de réseau, d’Internet et/ou d’ordinateur ;
e) toute incapacité du gagnant à accepter un prix, quelle qu’en soit la raison ;
f) l’impossibilité d’attribuer un prix en raison de retards et/ou interruptions causés par des cas de force majeure, catastrophes naturelles, actes de terrorisme, conditions météorologiques, ou tout autre événement similaire hors du contrôle raisonnable du Commanditaire ;
g) tout dommage, blessure et/ou perte, de quelque nature que ce soit, causé(e) par ou résultant de l’attribution, l’acceptation, la possession, l’utilisation, la mauvaise utilisation, la perte et/ou la mauvaise orientation de tout prix, et/ou résultant de la participation au présent tirage ou à toute promotion ou activité liée aux prix.
Le Commanditaire se réserve le droit, à sa seule discrétion, de disqualifier toute personne qu’il juge :
x) être en train de manipuler le processus de participation et/ou le fonctionnement du tirage, du site Web du tirage, et/ou de tout site Web lié à la promotion du tirage ;
y) agir en violation des présentes Règles officielles ; ou
z) participer ou tenter de participer plusieurs fois au tirage en infraction aux Règles officielles, et/ou utiliser tout système robotisé ou automatisé pour soumettre des participations.
Si le Commanditaire détermine, à sa seule discrétion, que des difficultés techniques, des défaillances, erreurs, perturbations, dommages ou tout autre événement imprévu compromettent l’administration, la sécurité, l’équité, l’intégrité, le bon déroulement ou la viabilité du tirage, il se réserve le droit d’annuler les participations concernées, et/ou de mettre fin à la partie concernée du tirage, voire au tirage dans son intégralité, et/ou de le modifier et/ou d’attribuer les prix à partir de toutes les participations admissibles reçues jusqu’à la date de résiliation.
Le Commanditaire se réserve également le droit de suspendre, modifier et/ou annuler le tirage avant la date de fin prévue.
En cas d’annulation du tirage, toutes les participations seront nulles et non avenues, tous les paiements seront remboursés, aucun gagnant ne sera désigné et aucun prix ne sera remis.
LOI APPLICABLE ; DIVISIBILITÉ ; RENONCIATION :
Le tirage au sort et les présentes Règles officielles sont régis et interprétés conformément aux lois de la province de l’Ontario et aux lois du Canada applicables dans cette province.
Si un tribunal compétent juge qu’une disposition des présentes Règles officielles, ou son application à une personne ou à une situation particulière, est nulle ou inapplicable en tout ou en partie, le reste des Règles officielles, ainsi que leur application à d’autres personnes ou situations, ne seront pas affectés par cette décision et resteront pleinement applicables dans les limites permises par la loi.

Le fait pour le Commanditaire de ne pas faire valoir une disposition des présentes Règles officielles à un moment donné ne constitue pas une renonciation à cette disposition ou à toute autre disposition, et n’empêchera pas le Commanditaire de faire valoir ultérieurement ladite disposition ou toute autre disposition.

CONVENTION D’ARBITRAGE OBLIGATOIRE ; RENONCIATION AUX RECOURS COLLECTIFS :
Toute réclamation, autre qu’une réclamation formulée par le Commanditaire, qui ne peut être résolue à l’amiable, doit être réglée conformément aux dispositions d’arbitrage ci-dessous.
Sauf si la loi fédérale l’interdit, chaque participant, y compris, sans s’y limiter, tout Gagnant potentiel ou Gagnant du tirage, accepte de soumettre à UN ARBITRAGE INDIVIDUEL EXÉCUTOIRE toute réclamation ou tout litige ayant un lien, de quelque nature que ce soit, avec :
• la participation au tirage,
• la sélection d’un Gagnant potentiel ou d’un Gagnant, ou
• la remise ou l’attribution du Grand Prix ou de tout autre prix du tirage
(collectivement, les « Réclamations arbitrables »),
à l’exception des Réclamations arbitrables portant sur la validité, la portée ou l’applicabilité de la présente clause d’arbitrage.
La présente Convention d’arbitrage est régie par la Loi sur l’arbitrage de l’Ontario, 1991.

RÉCLAMATIONS EN ARBITRAGE : Dans toute Réclamation arbitrable soumise à l’arbitrage, ni le participant ni le Commanditaire ne pourront bénéficier d’un procès devant un tribunal ou un jury, ni participer à un recours collectif ou à un arbitrage collectif. D’autres droits que le participant ou le Commanditaire auraient devant un tribunal ne seront pas disponibles ou seront plus limités dans le cadre d’un arbitrage, y compris le droit d’interjeter appel.
Les participants renoncent expressément à leur droit à un procès devant un tribunal ou un jury.
Tous les différends doivent être tranchés individuellement, et non dans le cadre d’un recours collectif, d’une action représentative, d’un arbitrage collectif, ou de toute autre procédure similaire.
L’arbitre (ou les arbitres) ne peut/pourront pas regrouper les réclamations de plusieurs parties.
L’autorité de l’arbitre est limitée au participant et au Commanditaire uniquement, sauf indication contraire expresse dans les présentes.
Aucune décision arbitrale n’aura d’effet contraignant à l’égard de personnes non parties à l’arbitrage.
La décision de l’arbitre sera définitive et exécutoire.
Les parties conviennent que la présente disposition d’arbitrage s’applique à toute autre partie impliquée dans une Réclamation arbitrable, y compris, mais sans s’y limiter, les Parties exonérées de responsabilité.
En cas de conflit, la présente clause d’arbitrage prévaut sur les règles de l’organisme d’arbitrage ou de l’arbitre.
Frais d’arbitrage :
Les frais de l’arbitrage seront partagés également entre le Commanditaire et le participant, mais chaque partie devra assumer ses propres frais et honoraires d’avocat liés à sa participation à la procédure.
Clause de divisibilité :
Nonobstant toute autre disposition des présentes, si la renonciation au recours collectif ou l’interdiction de l’arbitrage collectif est jugée invalide ou inapplicable, l’ensemble de la clause d’arbitrage sera considéré comme nul et non avenu.
Si toute autre partie de la présente clause d’arbitrage (à l’exception de la renonciation au recours collectif et de l’interdiction de l’arbitrage collectif) est jugée invalide ou inapplicable, cela n’affectera pas la validité des autres dispositions restantes de cette clause.

Avant d’engager une procédure d’arbitrage en vertu de la présente disposition, le participant doit transmettre au Commanditaire un avis écrit de la Réclamation arbitrable (un « Avis de réclamation ») et lui accorder une possibilité raisonnable d’au moins trente (30) jours pour résoudre ladite réclamation.
Tout Avis de réclamation destiné au Commanditaire doit être envoyé par courrier postal à l’adresse suivante :

L’Avis de réclamation doit obligatoirement :
a) identifier le participant par son nom, son adresse, son adresse courriel et son numéro de téléphone ;
b) expliquer la nature de la Réclamation arbitrable et la compensation demandée ;
c) être soumis uniquement au nom du participant, et non au nom d’une autre personne ou entité.
Le participant s’engage à collaborer raisonnablement en fournissant les informations concernant la Réclamation arbitrable que le Commanditaire pourrait raisonnablement demander, et à lui accorder une possibilité raisonnable de répondre à la demande de compensation.
Les dispositions du présent article ne s’appliquent pas aux réclamations formulées par le Commanditaire.

AVIS :
Le Commanditaire se réserve le droit d’engager des poursuites et de réclamer des dommages-intérêts contre toute personne tentant délibérément de compromettre le bon déroulement du tirage au sort, en violation des présentes Règles officielles et/ou en infraction au droit pénal et/ou civil.
